CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

June 16, 2008

 

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, June 16, 2008, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Ms. Martin was to have a public hearing, due to a mishap with the Times Tribune the notice was not published and the public meeting has been postponed until next month.

Jerry Elden Hill                                  2117 S Main Street                            $100               

Citation#0508-168                              Property Maintenance

A status report was given by Mr. Burke on the property located at 2117 S Main Street. Mr. Burke explained that Mr. Hill refused to sign the citation and it was returned to the office. After the attempt to serve the citation, he mowed his grass and then came by the office of the Code Enforcement Office. Mr. Hill was upset that we cited him and wanted to know why we had not notified him by phone before sending him a citation.

Chairman White asked if Mr. Hill was informed that the fine would increase to $500 if the fine was not paid? Mrs. Patterson explained to Mr. Hill that the fine can be raised. Mr. Knuckles explained he felt the $100 fine was enough at this time. Motion was made to set the fine at $100 and give Mr. Hill 30 days to demolish the storage building. Mr. Knuckles recommended that the Board revisit this during the August meeting.

Melinda & Kirk Bodenweiser                       312 Vandorn Street                            $100

Citation #0508-167                                         Property Maintenance/Unfit Structure

A status report was given by Mr. Burke on property located at 312 Vandorn Street. The Bodenweisers bought the property in December with plans to move in. They went back to Florida and since they had not had to mow in Florida they did not think about the grass being so high here in Kentucky.

The Bodenweiser's came to move in and found the red tag on the door and immediately came into the Office of Code Enforcement. They paid the mowing fees so Mr. Burke told them due to the unusual circumstances he would ask the board to rescind the fine.

Motion was made to rescind the fine and close the case.

Phillis Stewart                                                509 Vaughn Street                             $100

Citation # 0508-160                                        Property Maintenance/Unfit Structure

A status report was given by Mr. Burke on the property located at 509 Vaughn Street, the property is vacant, the citation came back unclaimed.

Chairman White said he was sure that the property was foreclosed on two years earlier. Mr. Burke suggested that the Code Enforcement Office do a title search and place a lien on the property.

Mr. Knuckles ask if a title search was necessary. Mr. Burke explained that a title search is not totally necessary, but if the property has changed hands we have lost what we have in the property. At this time we have a mowing crew employed by the city and the money is not coming directly out of the Code Enforcement Boards budget.

Chairman White ask at the end of the mowing season if nothing has been paid or taken care of will we revisit the property and apply a second lien. Mr. Burke explained he would check all properties and apply if necessary a second lien after the mowing season is over.

Motion was made to keep the fine at $100, place a lien on the property and readdress the property and apply a second lien at the end of the mowing season for any additional costs.

John P. Chappell                                618 Gordon Hill                                  $100

Citation #0508-171                             Property Maintenance/Vacant Structure

A status report was given by Mr. Burke on the property located at 618 Gordon Hill. This was originally the Denver Hensley property, Mr. Burke talked to Mr. Chappell on August 09, 2007 and he told Mr. Burke he bought the property to resale and he would maintain the property. It was mowed that morning and has not been mowed since.

Mr. Burke checked with the PVA Office and he is still listed as the current owner. He did sign for the citation, but has done nothing to date.

Motion was made to set the fine at $100 and place a lien on the property and have the City mowing crew mow the property and then put another lien on the property after the mowing season is over.

Lenny and Vickie Henderlight          529 Roy Kidd Avenue                       $100

A status report was given on the property located at 529 Roy Kidd Avenue. Mr. Burke sent the PVA number to the PVA office to check ownership of the property. It came back with Lenny and Vickie Henderlight as the current owners.

Mr. & Mrs. Henderlight produced documentation that they had actually sold the property back in January. Mr. Burke had already red tagged the house but received no response, so he cited the property. Since this time the property has been mowed and cleaned up.

Mr. Burke was told that the property was sold to Adam Hill. At this time Mr. Burke is asking to rescind the fine and abate the violation due to incorrect ownership identification on the citation.

Chairman White asked Mr. Burke if he noticed the roof on the house, Mr. Burke explained he did notice the roof and would have to go back and cite the correct owners after this citation was dismissed.

Motion was made to dismiss the citation.

Charles Neal                                      409 3rd Street                                     $100

Citation #0508-162                             Vacant Structure & Land / Exterior Property

A status report was given by Mr. Burke on the property located at 409 3rd Street. Mr. Burke explained that Mr. Neal owned a lot on 3rd Street. Mr. Burke had been told that he sold the lot.

This year the lot has not been mowed. The PVA Office still has Mr. Neal listed as the owner. Mr. Burke then cited Mr. Neal. To date no response has been received. During this time the lot was mowed and has been maintained since.

Mr. Burked recommend that at this time the fine stand at $100 and place a lien on the property for the fine and any additional administrative fees and costs.

Motion was made to fine Mr. Neal $100 and place a lien on the property including all fees and costs.

Vernon Jr. & Gloria Taylor               605 W 6th Street                                 $100

Citation #0508-164                             Property Maintenance/Unfit Structure

A status report was given on the property located at 605 W 6th Street. This area was part of the community development grant. Because of this Mr. Taylor has not done a great deal of repairs and seem confused about what rubbish was. Mr. Taylor has continued to work on some of the issues, but has not done as much as Mr. Burke would like.

Mr. Burke would like to monitor the property and revisit it next month with a updated status of the progress being made. Motion was made to monitor the property and revisit it next month.

Richard & Julia Hann                        703 Lee Street                                   $100   

Citation #0508-165                             Vacant Structure & Land / Exterior Property

 

A status report was given on the property located at 703 Lee Street. This is another case where the PVA Office sent the incorrect ownership to the Code Enforcement Office. By the time Mr. Burke received the information on the owners; the property had been mowed and cleaned up. The property is owned by Geneva Pennington and is rented. Mr. Burke recommended that we rescind the fine and abate the citation.

Motion was made to rescind the fine and abate the citation.

Lenny and Vickie Henderlight          709 Bolton Street                               $100

Citation#0508-166                              Vacant Structure & Land / Exterior Property

A status report was given on the property located at 709 Bolton Street. This is another property that came back owned by Lenny and Vickie Henderlight but they are not the owners and never owned this property. The property is actually owned by Richard and Julia Hann.

There were two renters staying on the property. Although Mr. Burke red tagged it the owners were not notified. Since that time the property has been mowed and cleaned up. Mr. Burke has checked the property several times since and it is being maintained.

Mr. Burke recommends that the fine be rescinded and the citation abated.

Motion was made to rescind the fine and abate the citation.

Edward M. Douglas                           943 Gordon Street                             $100

Citation #0508-169                             Vacant Structure & Land / Exterior Property

A status report was given on the vacant lot at 943 Gordon Hill. There has been an issue with this property before. The owners do not monitor their property. Mr. Douglas lives out of town but he did call and promise to have the lot mowed by the weekend.

Mr. Douglas seven days are not up at this time, the Board asked Mr. Burke to continue to monitor the property and readdress the situation next month.

Henry Honeycutt                               1029 5th Street                                                $100

Citation #0806-114                             Property Maintenance/ Unfit/Unsafe

A status report was given on the property located at 1029 5th Street. Dennis Wood has purchased the property owned by Henry Honeycutt. Mr. Wood in the agreement of the sale paid the dumpster fees and maintenance fees. Because of pending ligation we never filed a lien on the property.

Attorney Bob Hammons requested that Mr. Burke ask the Board to rescind the fine and dismiss the case since Mr. Honeycutt no longer owns the property. Attorney Hammons assured Mr. Burke that he would have the dumpster fees and maintenance fees paid.

Motion was made to rescind the fine and dismiss the case.

KY Truck Stop Services                    Jct I-75 & 25W                                 $125

Citation #0208-158

Mr. Burke explained this was the case where a 55 gallon drums and a large amount of garbage was abandoned on the vacant property. Mr. Burke contacted KY Truck Stop Services and the garbage was immediately cleaned up, but the drum was not removed.

Mr. Burke contacted KY Truck Stop Services again and they said they did not own it. They stated that a company called GeoScience Consultants was the owner. GeoScience Consultants sent a representative out to check the drum and determined it was not their drum. They examined the drum and determined it contained only water.

The Office of Code Enforcement notified KY Truck Stop Service with a copy of GeoScience Consultants letter stating it was not there drum. Soon after the drum disappeared.

Mr. Burke asked what the pleasure of the Board was. Motion was made to dismiss the citation and rescind the fine.

Danny Davenport                              235 Hatfield Street                            $100

Citation #0508-161                             Vacant Structure & Land / Exterior Property

A status report was made by Mr. Burke on the property located at 235 Hatfield Street. Rosa Adkins actually owns this home. It is being bought on land contract. Ms. Adkins called begging Mr. Burke to not do anything; she will get the property cleared up. She explained that due to a lot of illness, she has not been able to maintain the property. The property has been mowed and cleaned up.

Motion is made to monitor the property and give them 60 days to see if it has remains in compliance.

Lee Ann Maxey Barger                    115 Bishop Street                              $100

Citation #0508-170                             Vacant Structure & Land / Exterior Property

A status report was made by Mr. Burke on the property located at 115 Bishop Street. Mr. Burke actually contacted Ms. Barger giving her a ultimatum on demolition of the structure. She told Mr. Burke she could not afford to demolish the house. She did come in and paid her fine.

There has been no movement since the fine was paid. But her 30 days to demolish the structure is not up till the first of July.

Motion was made to give her 30 days to demolish the structure. Mr. Burke recommended to not let it go much longer due to the unsafe nature of the structure.

Ascencious Group                              414 3rd Street                                     $150

Citation #0508-163                             Vacant Structure & Land / Exterior Property

A status report was made on the property located on 414 3rd Street. This property is one we have to mow and maintain every year. Countless measures have been made to contact the owner with no response. This property has a lien on it already. Mr. Burke recommends the fine be set at $1000.00 plus cost and a second lien be filed. Then turn over to the city attorney to foreclosure.

Motion was made to increase the fine to $1000.00, contact the City Attorney and proceed with lien and foreclosure.

Chairman White asked about portable basketball goals on the sidewalks. Mr. Burke stated there is nothing in the ordinance that says they can not have them on the sidewalk. Mr. Burke stated he would look into the problem and ask them to move the goals.

Chairman White brought up the problem about the rising number of portable metal buildings that are being brought into the city limits. Mr. Burke explained that maybe he could address the issue of the portable buildings and recreational vehicles in the front yards with the Planning Commission.

Several properties that need to be cleaned up around the city were discussed.

Mr. Knuckles ask the status on the parking citations. Mrs. Patterson explained that most citations were paid and she had not received any more since the last batch. The Board discussed the option of what can be done as far as unpaid fines and liens on their personal vehicles.

Mr. Burke explained that anyone not paying the fine can be subpoenaed to appear before the board and the fine increased if it is not paid.

Mr. Knuckles explained you can not raise the fine if there has not been a public hearing. Mr. Burke stated that once notified and it goes into default the Board can set the fine at any amount up to the maximum.

Motion was made to subpoena those that do not pay their fine for the parking citations and do not respond after notification.
