CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

May 5, 2007

 

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, May 5, 2008, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Approve the Minutes from Last Meeting: April 7, 2008

All present voted Yea. None opposed.

Mrs. Patterson brought up a parking fine by Paula Wagers. Mrs. Wagers had asked to address the board on the May 5th meeting but had to come to Corbin that day and could not make it back from London that night. She requested the fine be dismissed since she had sold the vehicle and did not own it at the time the citation was issued.

Mrs. Wagers produced a bill of sales showing she sold the vehicle on November 7, 2008 and a tax bill showing she had paid the taxes, but the title had still had not been changed from her name. Mrs. Wagers explained when she got the tax bill she went to the clerk's office and had the vehicle junked out.

Mrs. Patterson spoke with David Alsip who is the Chief Dispatcher and he explained that no bills are sent out except the initial fine. However the set of parking fines that was given to the Code Board had bills sent out. One mailing was sent out on Aug 17 and the second Sept 14, but this was a one time mailing.

Mr. Knuckles asked when Mrs. Wagers was citied initially. The original citation was December 08, 2007. Mrs. Wagers sold the vehicle on November 3, 2007. Mr. Knuckles commented that a few of the citations that were given to the Code Board were for handicap parking violation but the rest were for parking on the sidewalk.

Mr. Knuckles read the ordinance stating that the code board does not have any jurisdiction over any parking citations other than parking on the sidewalk.  

ORDINANCE NO. 8-2007

AN ORDINANCE OF THE CITY OF CORBIN, KENTUCKY MAKING IT UNLAWFUL TO PARK A MOTORIZD VEHICLE OF ANY TYPE ON ANY SIDEWALK IN THE CITY OF CORBIN, IN ANY WAY OR MANNER, AND GRANTIN THE CODE ENFORCEMENT BOARD WITH JURISDICTION TO ENFORCE THIS ORDINANCE AND ASSESS CIVIL FINES PURSUANT TO ORDNNANCE NO. 12-2003

There was extensive discussion as to what the Code Enforcement Board has the authority to rule on and what they can not rule on.

Mr. Knuckles recommended that the fine for Mrs. Wagers be rescinded and dismiss the citation.

All present voted Yea. None opposed.

Mr. Burke commented that we have some work yet to do on the parking tickets and there needs to be a working system in place. He assumed that the police department notified the person cited and those that did not respond within 60 days were turned over to the Code Board. He feels he has misunderstood the procedure being followed in regard to the parking tickets.

Chairman White stated he felt that the ticket should state an amount of time that the cited individual is allowed to pay the ticket. After a stated amount of time they should be charged an additional fee and go before the Code Enforcement Board.

Mr. Knuckles expressed that he felt 60 days was too long to wait on the tickets. He feels we need a fine schedule put in place by the Commissioners. He feels the whole system with parking tickets needs to be clarified.

Mrs. Patterson went over the parking tickets that had been paid since she sent out the first notices. Several of the tickets were paid before the office of Code Enforcement received them, one was deceased, and three have come in to pay.

Mr. Burke explained that he was trying to get some of the yard maintenance started. At first the city had planed on using inmates to mow. Preparations were being made to use the inmates but it has not worked out so far. Mayor Willard McBurney asked Mr. Burke to precede as in the past and use the city contract laborers to mow for now.

Mr. Burke went into some various properties of interest to the Code Board and how the Code Enforcement Board should proceed in getting the properties mowed.

Mr. Burke has left many red tags on various properties. Mr. Knuckles ask how many warnings that Mr. Burke leaves before citing the property owners. Mr. Burke explained he leaves one red tag then he will go back and cite the owners if action is not taking.

Mrs. Patterson gave a report in regard to the properties that have been mowed.

Chairman White asked if there was any other business to be addressed. There was none.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
