Regular Scheduled Meeting

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, April 7, 2008, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

A status report was given by Mr. Burke on the Troy Mock property. Mr. Burke explained that originally when Mr. Mock's property was written up he took a little time to get things done but eventually did clean up the property.

Mr. Burke made the recommendation that the Board abate the violation and rescind the fine. Chairman White asked if he did what he said he would do, Mr. Burke explained that he bagged all the cans and moved the cars as asked.

Mr. Knuckles asked how Mr. Burke proceeded with the citation. Mr. Burke explained that Mr. Mock could not afford to pay the fine and he told them if they would get all of the property cleaned up and he would ask the Board to rescind the fine.

The motion was made by Trent Knuckles to rescind the fine and dismiss the case.

Billy & Christina Simpson      1215 Maple Lane                               $100.00

Citation#0208-156

A status report was given by Mr. Burke on the Billy and Christina Simpson property. The property had eight to ten vehicles on the property, all lined in a nice straight line. Mr. Burke suspected he was running an auto business and cited Mr. Simpson for running an illegal business.

Mr. Simpson explained to Mr. Burke he was not running a car lot but that all the vehicles belonged to family members and he was just repairing them for his family.

Mr. Burke explained that Mr. Simpson removed all the vehicles. His recommendation is that the Board abate the citation and rescind the fine.

The motion was made by Trent Knuckles to rescind the fine and dismiss the case.

A status report was given by Mr. Burke on Trae Pennington property.  Mr. Burke noticed a computer repair service sign. Mr. Burke found no one home and determined the property was a rental owned by Mr. Pennington.

Mr. Burke cited the occupant and sent a copy to Mr. Pennington. Mr. Pennington contacted Mr. Burke's office stating he was unaware that they were doing any business and thought it was more of a hobby than a business, but would check in on it. Mr. Burke went by the next day and the sign was gone.

Mr. Burke made the recommendation that the Board abate the citation and rescind the fine.

Margaret & Zach Meadows   1509 Madison Street                          $100.00

A status report was given by Mr. Burke on the Margaret and Zach Meadows. Mrs. Meadows has paid the fine and has already started working on the remedial measures.

Chairman White asked if the property has been cleaned up. Mr. Burke explained they have been working on the property and trying to get things cleaned up. Mr. Knuckles ask if the structure was vacant and Mr. Burke explained that he has seen no one in the house during inspections.

Chairman White commented he wished to keep this on hold till all remedial measures are completed and bring it back to the board after thirty days. Mr. Burke explained he does have a new phone number and will contact Mrs. Meadows if work does not continue.

Kentucky Truck Stop Service            Abandoned Drum                               $125.00

Citation #0208-158

A status report was given by Mr. Burke on Kentucky Truck Stop Services. There was an abandoned drum left on the property as well as a sizeable amount of garbage. Mr. Burke cited the owners of the property and they contacted a firm called Geo Science Consultants Incorporated stating it was their drum and they were responsible for the drum.

The garbage has been cleaned up, but the drum still remains. Geo Science Incorporated sent someone down to check the drum to see if it was theirs. The Geo Science Incorporated representative called the Code Enforcement office stating it was not their drum and they were not responsible but did check to see what was in the drum. According to the findings of Geo Science Incorporated that drum has only water in it.

Mr. Burke addressed the board asking if they wished him to notify them again and readdress the issue. Chairman White told Mr. Burke to notify the owner of the property and tell him to remove the drum.

Mr. Jones made the suggestion that Mr. Burke send the owners a letter notifying them that Geo Science Incorporated determined that it is not their drum and that Kentucky Truck Stop Service needs to have the drum removed.

Mr. Jones suggested that we send him the report from Geo Science Incorporated and tell them this was the report the Code Enforcement office received. If he removes the barrel we will rescind the fine and abate the order, if not we will increase the fine and place a lien on the property.

Mr. Burke asked if the Board wishes to put an order in place to up the fine to $500 and place another lien on the property.

Chairman White asked if there were any parking citations written this month. Mrs. Patterson got all the tickets over 90 days old on Friday. Mrs. Patterson explained that she spoke to David Alsip about working with them on how to deal with parking tickets.

Mr. Knuckles asked how we were going to address the parking violations. Mr. Burke explained that he needed to find the ordinance on the fine rates and what is the best way to work out etc. each violator.

Chairman White asked if there were any other business to be addressed? There was none.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
