MINUTES OF THE MONTHLY

CORBIN PLANNING COMMISSION

Regular Scheduled Meeting

Date: March 20, 2008

 

TIME AND PLACE

 

A Public Hearing with the Corbin Planning Commission was held on Thursday, March 20, 2008, at 4:00 P.M. at the Corbin City Hall Government Complex First Floor Conference Center, Room 116.

Roll Call / Members Present:

Public Hearing:

  • Public Hearing Session Opened for the proposed Annexation Request:

The real property proposed to be zoned and annexed is the same real property owned by 5-K Incorporated, P.O. Box 466, Corbin, KY 40701, all real property being located in Knox County, Kentucky and more particularly described as follows: The property located adjacent to Blockbuster Video on Highway 1629 (Ohler Road), in Knox County, Corbin, Kentucky.

Chairman Robinson asked Mr. Burke to orientate the board on the proposed annexation request for 5-K Incorporated. Mr. Burke explained that the request is to build an office building on the property located adjacent to Blockbuster Video on Highway 1629, Ohler Road in Knox County. The land is contiguous to C-1 on two sides. Highway 1629 is zoned as C-1 as well as Blockbuster Video.

Chairman Robinson asked if anyone had comments on the zone request at this time? There were no comments. Chairman Robinson addressed Mr. Burke, are you satisfied that adequate services are available for the building?

Mr. Burke explained that everything there is provided with city sewage, although they are in a different water district. Our Fire and Police have no problem servicing the area; public works is already providing waste disposal in that area now.

Mr. Surmont asked about the area surrounding the proposed site. Mr. Burke explained that the area surrounding the proposed site is in the city other than one section never brought in.

Mr. Heaberlin asked if the building would take the total lot up. Mr. Burke explained that the building would not take up the complete lot and adequate parking would be provided.

Mr. Burke explained that the City Commissioners have accepted the proposed annexation. Chairman Robinson asked what type of business was proposed for the building.

Mr. Burke asked Mr. Keck to explain. He stated that at this time the only tenant they have commented is Enterprise.

Chairman Robinson asked if there were any further questions at this time? There were no further questions.

Chairman Robinson declared the public hearing is now closed and will now convene for the regular business meeting.

Regular Meeting of the Planning and Zoning Commission Called to Order

Minutes of October 18, 2007 Meeting were reviewed, discussed and approved.

New Business:

First item in new business is the proposed annexation for the property owned by 5-K Incorporated, located adjacent to Blockbuster Video on Highway 1629 (Ohler Road), in Knox County, Corbin, Kentucky.

Chairman Robinson explained that the Commission does not recommend whether or not to annex, but if the proposed property is annexed what the classification should be.

Chairman Robinson asked Mr. Burke to explain the proposed zones that are available and what zone Mr. Burke recommends for the proposed property. Mr. Burke explained that C-1 is General Business which is our primary commercial zone; the other commercial zone is C-2 which is our downtown business area. The property proposed is contiguous on two sides by properties now zoned as C-1.

Chairman Robinson asked the pleasure of the matter of Commission on the proposed zoning of the property owned by 5-K Incorporated, located adjacent to Blockbuster Video on Highway 1629, in Knox County, Corbin, Kentucky

Mr. Surmont made the motion to recommend to the Board of Commissioners that the property in question be zoned as C-1.

Chairman Robinson asked Mr. Burke and Mrs. Patterson to prepare a letter recommending the proposed zoning to the City Commissioners for him to sign.

Chairman Robinson asked if there were any other new business to be addressed at this time?  Mr. Burke explained we still need some actions on the Development Ordinance.

Mr. Burke has a meeting with the City Attorney Bob Hammons to go over the ordinance on Cell Towers. The ordinance on cell towers was never completed. It needs to be added to the Development Ordinance. It included public hearings and discretionary uses that are controlled by the Board.

Chairman Robinson asked if adding the ordinance will fix the Development Ordinance alone. Mr. Burke explained that he needed to go completely through the Development Ordinance; there are conflicts in the Development Ordinance that need to be straightened out still.

Mr. Burke further explained that we have not proposed the definition on mini warehouses yet and we are required to have a public hearing on it because it is a text change, it was discussed in the last meeting and everyone was in agreement of the definition.

Mr. Burke explained that next month we will have a public hearing for a zone change on a piece of property on the other side of the railroad tracks. The commercial zone stops at the railroad tracks and this piece of property is contiguous to that property.

Mr. Burke further explained that the property in question is a house that he condemned a few years ago; Orkin is signing a contract that is contingent upon the zone changed to commercial. He will buy the property and relocate his business to Corbin if it is approved.

Chairman Robinson brought up further discussion on the Developmental Ordinance. There was discussion of doing a revised version of the Developmental Ordinance. Mr. Burke asked the Board to look over the Developmental Ordinance and give him any changes needed.

Mr. Burke explained that once they were ready to accept the revised version of the Development Ordinance there will have to be a public hearing to adopt the new Ordinances. Mrs. Patterson explained that she had been working on many of the errors, but it needed to be looked over by someone other than her to make sure she had not missed anything.

Mr. Heaberlin asked Mrs. Patterson if she had a copy of the Developmental Ordinance on Microsoft Word and could she email it to him. He will go over the working copy and see if he can see any other errors that she and Mr. Burke have missed. Extensive discussions ensued on the Developmental Ordinance and how to put the Comprehensive Plan on disk as well.

Further discussion was brought up about the mini warehouse definition. Mr. Burke explained he would advertise in the newspaper next month for the public hearing.

Mr. Surmont asked about the traffic lights being installed on the south end of Corbin where Applebee has been built. Mr. Burke explained that he was informed that the Department of Transportation had said they would install traffic lights by the time the coliseum was built.

Old Business:

Chairman Robinson asked about the letter that was included in the Boards packets this month. Mr. Burke explained that an illegal billboard was constructed on Parkway Church of God property before anyone realized it was being constructed. There were initially two permits issued on each side of the property.

Another company had approached Mr. Burke for a permit to construct the billboard and he denied them the permit. Another company came in and constructed the billboard stating the property was not in the city limits. Now the company does agree it is in the city but will not construct the second bill board.

The company that was denied a permit is threatening to sue if the city does not make the other company take the billboard down. At this time the city attorney is talking to the billboard company's attorney.

Ms. Copeland asked Mr. Burke where the city limits were in that area. Mr. Burke explained that the Parkway Church of God is in the city limits and Clayton Mobile Home next to the church is not in the city. Coming back toward town Piccard's is not in, Arby's is in, the veterinary clinic and Wendy's is not in. Across the street King Buffett is in, but the building next to it is not in.

Chairman Robinson commented that the portion of land where the cell tower is located is not in the city limits. Mrs. Martin asked why some of the Keck property was not in but Kings Buffett is in. Mr. Burke explained that they requested to be brought in so they could have the city sewage and facilities.

Mr. Robinson asked Mr. Burke why you have to get a state permit within the city limits? Mr. Burke explained that the only thing the State does not restrict is one and two family homes and a few of the smaller commercial buildings. 

Chairman Robinson asked if the church had commented on it at all. Mr. Burke explained that the church has not commented on the billboard at all but the company did not build the second billboard.

Mr. Burke explained also we have two people talking to us about annexation, B&H Shoes and Allen Bray Auto Sales. B&H wants to tap on the sewer but they would have to work out something with Legend Motors and hook on to their force main. They will still have to pay a tap fee, so he is not certain they will ask to come in.

Mr. Burke explained other than the zone change that was all he had. Mr. Surmont asked where the proposed zone change is? Mr. Burke explained that the property Bryan Barton had on Union and White Street is requesting the zone change.

Mr. Burke explained that all the area across from the property is C-2 and that Depot Street is the dividing line.

In regard to a new improved zone map, Mr. Burke explained that he spoke to Attorney Bob Hammons about getting a new zone map. Attorney Hammons explained that they would not have to have a public hearing to adopt a new zone map just because it is now digitized on the computer.

Chairman Robinson asked if there was any other discussion.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
