CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

November 5, 2007

 

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, November 5, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Approve the Minutes from Last Meeting: October 1, 2007

A status report was given by Mr. Burke; Ms. Martin owns a vacant lot on North Kentucky Street. Mr. Burke gave her a verbal warning; however, it was not mowed. He mailed a citation out but before the citation was received she had mowed and cleaned up the lot.

Mr. Burke explained according to the Code Enforcement Manual, if all remedial measures are made the Board has the option to drop the fine and abate the citation. Mr. White suggests that if Ms. Martin is in violation again next year, there should be no warning given. She should be immediately cited as a repeat offender. Mr. Knuckles agreed, since she is a repeat offender every year there should be no more verbal warnings. If there is any further infraction she will be fined.

A status report was given by Mr. Burke; Mr. Combs is listed as the owner of record, but is deceased. We have tried countless times to contact someone. Ms. Patterson stated Mrs. Combs is in a nursing.

Mr. Burke suggested that a title search should be done and a lien filed on the property for maintenance and administrative costs. Mr. Burke explained that when the home burned Mrs. Combs did get the structure cleaned up and kept the lot maintained, this year it has not been.

With further discussion the board decided to hold off on all action till the first of the year to see if anything was done to the property. Mr. Knuckles made a motion to dismiss the citation at this time.

A status report was given by Mr. Burke. The citation was returned, we were unable to make contact with the owner, and we were unable to contact the finance company as well. The finance company is called Transamerican Finance Corporation.

Mr. Burke's recommendation is to do a title search and place a lien on the property before it is sold or through bankruptcy lost. Mr. White ask what shape the structure was in, Mr. Burke explained that the structure is in good shape.

Motion is made by to leave the citation at $100.00, file a lien, administrative cost and maintenance fees.

A status report was given by Mr. Burke. The property was vacant when he red tagged the property. Apparently the people renting the property moved and the owners live out of town. The day we printed the citation to mail the owners called and they had already cleaned up the property and have continued to maintain the property since.

Mr. Burke recommended we rescind the fine and close the case.

Vernon Jack Calhoun              Vacant Structure                                 100.00

Case # 0808-147

A status report was given by Mr. Burke. Mr. Calhoun inherited the house when his mother passed away. The citation was issued soon after he moved in. He immediately started to do remedial measures. Mr. Burke gave him two 30 days extensions while he was working on the house.

Mr. Burke explained all the repairs had been made. Mr. Calhoun came in to let Mr. Burke know that all remedial measures have been completed. Mr. Burke told Mr. Calhoun he would bring his case before the board and ask them to rescind the fine and abate the citation.

Motion was made by Chairman Jones to rescind the fine and close the case.

Mr. Knuckles brought up for discussion the Jeffery Hotaling case. Mr. Knuckles ask if there was not an order in place to demolish the house. Mr. Burke explained that they have been working around the house by clearing away the rubbish, garbage, trash, and all abandoned vehicle.

Mr. Burke explained the property has been maintained, but nothing been done to the outside of the house at this time. Mr. Burke reported that in the last meeting Ms. Taylor stated that in two days, funds would be available to pay the fines; to date neither Mr. Hotaling nor Ms. Taylor, the property manager, has come in to pay the fines due. Mr. Burke stated all remedial measures have not been completed, except repairs to the structures.

Mr. Burke explained that the structure was not is in danger of collapsing, but was unsightly. Mr. Knuckles stated that the board had agreed to give them additional time providing the fines are paid.

Mr. Knuckles also pointed out that there was a demolition order place. Mr. Burke responded that it was his understanding that a reprieve was given to Mr. Hotaling as long as they were working on the property.

A lengthy discussion continued on how to proceed on the original demolition order. Mr. Burke said he would make contact with Mr. Hotaling and make an inspection of the property. After a discussion with the property owner Mr. Burke stated that he would then make a determination as to what manner to proceed.

Mr. Knuckles requested an update about the property of Earl and Jean Karr. Mr. Burke explained that there has been no work done on the property. He stated that they have until December to complete the project.

Mr. Burke gave a status report on the Honeycutt property. He had tried earlier to reach Attorney Bob Hammons but he was out of the office for the day. He tried to contact the mortgage company. Upon telephone contact he was given an alternate number. After calling the alternate number he was informed there were no agents available, so he left a message and a number but received no return call. Mr. Burke retagged the property with a new condemned sign.

Mr. Burke gave out photos of the house that was demolished on Poplar Street. According to the developmental ordinances the owners has one year to build back in the original footprint.  However the owner, at this time, shows no interest in doing so.

There was further discussion on the building setbacks in different areas of the city. Mr. Burke explained how different areas were set up with limitations.

Mr. White asked about the Tracy Apartments. There was further discussion about the structural soundness of the apartment building. Mr. Burke explained that he has had one engineer say it was structurally sound and one stated it was not structurally sound. The Lawson brother's donated the apartment building to the American Legion.

Mr. Knuckles asked Mr. Burke if he would ask for credentials from the engineer. Mr. Burke stated he wanted something in writing. He explained that if they determined that it was structurally unsound, then it should be removed. His concern now is can the American Legion afford to have the building removed?

Mr. Burke spoke to the Doc Butler the Commander of the American Legion this morning and he explained that they were going to start gutting the structure today. They will be removing the stoves, refrigerators, and any appliance that could be useful. They will be checked and sold or given to the needy.  

Mr. Burke stated his primary structural concern was the back corner. A large crack has developed and it appears to be pulling away from the building. He stated he had no way of knowing what may have caused the crack. All other issues can be repaired if the money is available. The primary goal is to convert it into a VA Clinic. At this time there is no commitment from any government agency, although they have contacted Hal Rogers and Mitch McConnell but have received no response.

Chairman Jones asked about the old hospital. Mr. Burke stated that the last he had heard the old hospital should be demolished by the first of 2008.

Chairman Jones made the motion that the meeting be adjourned.

The next scheduled meeting has been tentatively set for December 3, 2007.
