MINUTES OF THE MONTHLY

CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

October 1, 2007

 

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, October 1, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Approve the Minutes from Last Meeting: September 13, 2007

A status report was given by Mr. Burke. Ms. Hibbard was present for the hearing although her attorney had asked for a continuance. Mr. Burke explained that all remedial measures were taken and the car is licensed and insured, the property and all rubbish have been cleaned up and there is no existing violation at this point.

Mr. Burke explained to the board that he asked Ms. Hibbard to come forth and address the board since all remedial measures have been taken. He asked that the board rescind the fine and abate the violation.


Chairman Jones asked if there were any other violations besides the abandoned vehicle. Mr. Burke explained there was some old tires and rubbish, but all been cleaned up. Ms. Hibbard addressed the board and explained she brought proof of license and insurance on the vehicle. She explained she had tried to reach her attorney and received no response.

Mr. Burke explained he would send Ms. Hibbard's attorney a letter explaining the case was dismissed and closed and there is no reason for continuance.

Mr. Knuckles made a motion to rescind the fine and abate the violation.

  • Old Business

Mr. Burke addressed the board about the case of Jeffery Hotaling. Ms. Taylor is the Property Manager for Mr. Hotaling and was present to update the board on the status of Mr. Hotaling's property. Mr. Burke explained that the property had been cleaned up and the only thing that has not been completed is the remodeling of the buildings.

Ms. Taylor paid $900 on the fines, leaving a balance of $815.  Ms. Taylor wished to address the board and asked that they reduce or possibly rescind the fines.

Mr. Burke explained that he took the maintenance fees and attorney fees, and subtracted them from what was owed, leaving a balance of $815. He explained the only thing the board could reduce or rescind would be the fines.

Mr. White asked when the original notice was issued. Mr. Burke explained the first request for a hearing was over two years ago. Mr. Knuckles suggested that instead of rescinding the fine the board allow Mr. Hotaling more time to come up with the funds. Ms. Taylor explained that Mr. Hotaling had funds that would be available in a few days to pay the balance of the fines.

Mr. Burke asked, if acceptable to the board, if he could release the first lien and retain the second lien of $1,065. Mr. White asked how much was owed on the first lien. Mr. Burke informed him it was $550. The board agreed to release the first lien and hold the second pending the final payment.

Mr. Burke discussed some things that needed to be done to the house before the weather changed. Ms. Taylor explained that Mr. Hotaling planned on keeping the garage and would repair it as well as the house in the future. The board ordered Ms. Taylor to keep in touch with Mr. Burke but she will not be required to appear next month.

Chairman Jones made a motion to release the first lien but retain the second lien. Mr. Hotaling will be allowed an additional 30 days to pay the fine.

Status of Case #0407-123 Edward and Marjorie Parmon. Mr. Burke reported the fine was paid, and the house was torn down and cleaned up. Mr. Burke made the recommendation to dismiss the case, and added that all remedial measures have been completed.

 

Chairman Jones made the motion to dismiss case #0407-123, Edward and Marjorie Parmon.

A discussion ensued by the board members concerning various projects on going at this time in the area.

Mr. Burke discussed the status of the Vanessa Wilson property on Gentry Street. The property sold at public auction today. There is an outstanding lien for $38,000 at this time plus outstanding taxes. After bidding it sold for $2,500.

Mr. Knuckles brought up the property of Earl and Jean Karr. He asked if their time would be up in 30 days?

Mr. Burke stated that he was concerned that the project would not be completed within the approved time table. The deadline for completion is in December.

Mr. Knuckles made the motion to adjourn.

The next scheduled meeting has been tentatively set for November 5, 2007.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
