MINUTES OF THE MONTHLY

CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

September 13, 2007

 

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, September 13, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Approve the Minutes from Last Meeting: August 6, 2007

A status report was given by Mr. Burke. He stated that Mrs. Monhollen came into the Code Enforcement office today to give a progress report on the property. Their plans are to demolish the structure and clean up the property. Although it was late Mr. Burke gave them an extension of 30 days, in order to get the property cleaned up. If it is not done by next month Mr. Burke will bring it back before the board. If it has been done he will ask the board rescind the fine.

The board agreed to allow the extension for 30 days,

A status report was given by Mr. Burke. He stated the property has been vacant for some time and we have not been able to locate the owner. The city has maintained the property. The first notice was returned with a new address, the second came back returned with a third address. We sent the third notice out and the letter came back unclaimed. Normally when a letter comes back unclaimed it means they were notified but they did not pick it up.

Mr. Burke stated that in his opinion we have gone through due process and he feels the only recourse is to set a find, do a title search and place a lien on the property. The structure is sound so is not in need of demolition; this will just be for upkeep and maintenance.

Mr. Knuckles made a motion to place a fine of $500, do a title search, and place a lien on the property.

Mr. Burke explained that Ms. Hibbard had requested a public hearing in regard to her violation, but the request came in to late for the public hearing to be advertised in the newspaper. The public hearing will be put on the October Agenda.

A status report was given by Mr. Burke on the Hibbard property. He explained that there has been a previous problem with the Hibbard property. There has been a vehicle sitting on the property that is not licensed, and weeds were growing up around it, tires and other rubbish were piled up against the property.

Mr. Burke spoke to Ms. Hibbard and she had stated that she would clean up around the vehicle and pay her fine. He then received a request from attorney David O. Smith for a public hearing. Ms. Hibbard has cleaned up around the vehicle but she does not wish to get rid of the vehicle.

No action taken at this time.

Jeffery Hotaling                                907 Carter Street

The next item on the agenda is Jeff Hotaling. Mr. Burke explained that the board had already issued an order for the house and garage to be demolished and the lot cleaned up. Ms. Joy Taylor ask to address the board in Mr. Hotaling's behalf.

Mr. Hotaling is out of town and Ms. Taylor owns a Home Management Firm and is representing Mr. Hotaling. She has already had vehicles moved, the lot cleaned up and the rubbish removed.

Ms. Taylor brought pictures to show the board of the work she has already done and explained what she has planned in remolding the house. Mr. Knuckles ask if Mr. Hotaling had not requested a public hearing once before. Mr. Burke stated that Mr. Hotaling did in fact request a hearing but did not show up for the hearing.

Mr. Knuckles ask various questions about how Ms. Taylor acquired the job of managing Mr. Hotaling's home and what it consists of. Mr. White made the suggestion to Ms. Taylor that she should get her privilege license to work in the city limits of Corbin as well as advise Mr. Hotaling to pay the fines and liens against his property.

Mr. Knuckles made the point that he did not think that they should not remove the demolition order until Mr. Hotaling paid the fines and brings the property up to date. Ms. Taylor ask what sort of time frame the board will give her on paying the fines and get the work done on the home. Mr. Knuckles suggested that the process of demolition be held off for thirty days and then the board will discuss the progress made.

Mr. Burke explained to Ms. Taylor that once the process of the remolding is ready to begin that they will need to get a building permit from the Building Inspectors office. He suggested she get with her contractor and get a idea of the area they are working with. Mr. Knuckles explained to her that they did not wish to give her a definite date to be finished; he explained that as long as they see progress and know they are working they would not set a certain number of days to finish the work.

Mr. Knuckles suggested that they put the demolition on hold and Ms. Taylor can address the board at the next meeting as to where they are on remolding the structure.

Jason & Megan Guthrie                   909 W Seventh Street           

#0607-131                                           Vacant House / Property Maintenance   

A status report was given by Mr. Burke. He stated the property has been vacant for some time and we have not been able to locate the owner. The city has maintained the property. In the mean thie a realtor acquired the property and it was sold. Mr. Burke contacted the realtor to pay the fine and she did.

Mr. Burke ask the board to close the case since to the home has been sold all fees and fines have been paid.

Danny Davenport                             205 Hatfield Street   

A status report was given by Mr. Burke that the house has been sold and the new owners are working on the home to bring it up to code. Mr. Davenport has paid the fine and Mr. Burke explained he would monitor the home and ask the board allow him to monitor the situation untill repairs are finished

Billy & Deborah Taft                        1919 Early Street

A status report was given by Mr. Burke that the house has been demolished and the property cleaned up. He ask the fine be rescinded and the case closed. Mrs. Patterson explained that Ms. Taft has kept in constant contact with her weekly on the progress of the demolition and cleaning up of the property. Mr. Burke ask the board to rescind the find and close the case. Mr. Knuckles made a motion that the case be closed and the fine rescinded.

Mr. White brought up a property on the corner of Carter and Engineer Street, use to be Sanderlin Grocery; the grass is very high and needs to be addressed.

Mr. Burke gave a status report on the Earl & Jean Karr. They have one month left to make the external repairs, Mr. Burke stated that he does not think they will make it, he explained several of the extenuating circumstances. He explained to the contractor that he needed to explain to Mr. Karr that it is very important that need to get to work on completing on the external repairs.

Mr. Knuckles inquired about the status of the title searches that were done. Mr. Burke explained that he had not spoken to the attorney but he would try to get with him on them this week. .

Mr. Knuckles inquired about the demolition on Poplar Street. Mr. Burke explained that he spoke to the owner of the property and he said it should be done this week. There had been numerous complaints on the property; Mr. Burke did go check on the property.

Mr. Knuckles ask about how Mr. Burke was going to handle the parking tickets that have been turned over to the Code Enforcement Board.  There was extensive discussion on the issues of the parking on sidewalk issues.

Mr. Knuckles addressed the issue of yard sale signs. He ask if Mr. Burke was going to try to collect the yard sale signs and go to each home and issue a citation. Mr. Burke explained he would most likely continue to address the problem as he had in the past. He will on Monday morning simply collect the signs and dispose of them.

Mr. Burke explained that it is not totally under the Code Enforcement Board yet. At this time there are no fine amounts set, there is no penalties, or standards established.

Mr. Knuckles made the motion to adjourn.

The next scheduled meeting has been tentatively set for October 1, 2007.
