    MINUTES OF THE MONTHLY

CORBIN PLANNING COMMISSION

Regular Scheduled Meeting

Date: June 14, 2007

 

TIME AND PLACE

 

A Public Hearing with the Corbin Planning and Zoning Commission was held on Thursday, June 14, 2007, at 4:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Public Hearing: Review Proposed Development Ordinance Amendment: Supplemental Regulations

  • 1. Public Hearing Session Opened for the proposed Development Ordinance Amendment: Supplemental Regulations.

Chairman Don Robinson explained to the Board and the audience that one item that was under consideration was changing the listing for mini warehouses from permitted to conditional.

 Chairman Robinson ask Mr. Burke to explain about the proposed Development Ordinance Amendment and the remaining items on the agenda for tonight's meeting.

Mr. Burke explained many local businesses have been putting in mini warehouses in the local business district. There has been concern raised by the commissioners and some residents as to where the mini warehouses were permitted to be located.

At this time it is permissible to install a mini warehouse in C-1general business district or commercial zone. Mr. Burke explained the only option he had come up with at this time, other than banning them completely, is to make them conditional use. By making them conditional they would have to go before the Board of Adjustments to build a mini warehouse storage building inside C-1 and C-2. C-3 is now regulated as a planned Shopping Center. Mr. Burke stated at this time we have nothing zoned C-3 in the city.

 

There have been other areas of concern due to the Main Street program trying to revitalize and preserve downtown. One being the controversial issue of the garage doors, and another is the sidings on the store fronts, possibly going with the brick frontages.

 

Mr. Hood ask for a specific definition of a mini warehouse or a mini storage unit and if we could get a more descriptive definition of what we were addressing as a mini warehouse or storage

unit. Mr. Burke explained in his opinion it would be listed as any rental storage building per say multi unit. Mr. Hood was concerned with the definition as some would stretch the definition. Mr. Burke agreed that there is a need for a more descriptive definition.

 

Mr. Heaberlin ask if there was an intent to do away with this type of storage building business. Mr. Burke explained there was not a concern to do away with that type of business, just to keep it out of the downtown area. We are making an effort to redevelop the main street area and preserve its integrity.

There was extended discussion as where the boundaries of C-1 and C-2 would extend as well as. The possibilities in height, size, and color of what a mini warehouse storage building could consist of.

Ms. Sharae Myers the Main Street Manager addressed the commission about the possible improvements to the downtown area. Ms. Myers advocated that she totally backed the new restrictions on the mini storage warehouses and discussed how the downtown area needs to be protected from loss of the historical integrity of the Main Street.

Ms. Myers suggested we carefully follow the Secretary of Interiors design guidelines toward preservation. Ms. Myers suggested the board set up guidelines and appoint a review board. All work would go before the review board for approval before any improvements are made to the buildings in the Main Street area.

Ms. Myers voiced concerns over the buildings left on Main Street that still held their historical integrity. Ms Myers indicated if we did not put a plan in place we may lose those building as well. Some of the buildings that have been modernized have lost their historical integrity and we need to have that protection as long as the building is viable it should maintain its character.  

Chairman Robinson ask Ms. Myers to define the extent of the area they are concerned with. Ms. Myers described the district they are interested in working in. By focusing on the revitalization and preservation efforts that once we become a certified city we can receive funding from the Kentucky Heritage Council. Ms. Myers noted that we possibly had ten blocks that could fall into this area.

Ms. Myers stated that the area they are trying to define with historical property starts at Tipton Law Offices on Roy Kidd Avenue and includes Depot Street, Main Street, Kentucky Street and Poplar Street, all the way to 11th Street, where Kentucky and Main Street rejoin.

Chairman Robinson ask Ms. Myers to address the community's feelings on the mini warehouse buildings going up in the historical area. Ms. Myers stated a set of guidelines should be developed in regard to empty areas limiting what can be constructed. A board should be formed and set into place to oversee what can and cannot be done in the historical district.

Ms. Myers suggested a comprehensive plan needs to be put in place addressing what should be done in the downtown area. Chairman Robinson ask Ms. Myers if she could put a recommendation together for the Planning and Zoning Commission.  Mr. Surmont reiterated the he would like a recommendation brought before the board with a set of guidelines and define the area of the historical district of downtown.

Ms. Myers stated that she would prepare a recommendation for the board.

Being that there were no further questions or discussion the hearing was closed

New Business

  • Recommendation on Review Proposed Development Ordinance Amendment: Supplemental Regulations

 

Chairman Robinson ask the thoughts of the commission of the proposed change the business service area from permissible in C-1 to conditional in C-1. Mr. Burke explained to the board that if C-1 were changed to conditional it must go before the Board of Adjustments for approval before it will be allowed to be built; this gives us some control without totally banning them.

Mr. Burke stated that in his personal opinion the board should ban the mini warehouses in C-2 or Downtown and make them conditional in C-1.  Mr. Burke explained that C-1 is the commercial area on the outskirts of downtown and C-2 is basically the downtown area.

Mr. Hood explained that with a vague definition of the mini warehouse it is hard to properly decide how to regulate the commercial areas of town. Mr. Hood stated that he would like a more descriptive terminology of what a mini warehouse is.

Mr. Surmont agreed that for the time being he would like a better description of what a mini warehouse is. Mr. Heaberlin ask if you could define a mini warehouse by its size or shape, or how much storage it can hold?

A motion was made that we ban mini warehouses in the downtown area C-2, and change C-1 to conditional.

All others present voted Yea. None opposed.

Chairman Robinson ask Mr. Burke to draft a letter to the City Commission with the recommendation of the Planning Commission to ban mini warehouses in the downtown area C-2, and make C-1 conditional.

Mr. Burke introduced Mrs. Patterson as the new Administrative Official working with him in the office of the Department of Codes and Planning.

There was no Old Business considered.

The next scheduled meeting and public hearing is tentatively set for July 19, 2007.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.

Mini-Warehouse/Storage Facilities: A facility consisting of a building or group of buildings located in a controlled-access compound that may or may not be fenced and gated, containing individual compartmentalized, and controlled-access storage units with individual lock capabilities for each storage unit, which are leased or rented to customers of the facility for  storage of those customers personal property, designed and utilized so that each customer had individual access to his or her unit exclusive of the access of other customers of the facility which is designed to function as a self-service facility.
