CORBIN CODE ENFORCEMENT BOARD

Regular Scheduled Meeting

July 2, 2007

 

TIME AND PLACE

A Public Hearing with the Corbin Code Enforcement Board was held Monday, July 3, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Status of Case #0607-126.  This is a vacant structure that has had no maintenance. There has been no response from the owner to date. The fines have not been paid and the city has maintained the mowing.

137-41-26-003                                    106 E 3rd Street         

Status of Case #0607-127. This is a vacant building that has had no maintenance. The building has been vandalized and there are several broke windows. The building needs to be secured.

Status of Case #0607-128. This is a vacant building that has had no maintenance. There has been no response and the city has had to maintain the mowing.

The meeting was called to order. Chairman Jones noted that there were not public hearings requested. Mr. Burke explained to the board that Mr. Karr is present and wished to address the board. Mr. Burke explained that there was apparently a misunderstanding about the timetable that Mr. Karr and Mr. Melton were to draw up for the board. Mr. Karr requested to address the board to clarify the issues.


Mr. Burke explained that Mr. Karr had made some notable improvements to the property. Mr. Melton spoke to the board and explained what improvements he had made on the property. Chairman Jones ask if there was going to be a problem making the timetable to present to the board. Mr. Karr explained they had not been able to come up with a timetable. He stated that he was not sure how to put it into words.

Mr. Burke discussed with Mr. Karr the various improvements needed and the amount of time it may take to complete the improvements. Mr. Knuckles explained to Mr. Karr that they needed the timetable in hand, if necessary with Mr. Burke could assist them. Mr. Burke stated he would not mind to help them draw up the timetable and that Thursday would be a good day to meet. Mr. Karr agreed to meet with Mr. Burke on Thursday.

Mr. Burke referred to the first Default case Don Peace at 405 3rd Street. The citation was accepted and is the second citation on this property. There has been no response to this citation to date. Mr. Burke stated he would like to proceed with a title search and place a lien on the property. Mr. Peace had the property mowed after the first offense and paid his fine, but there has been no response or action since the second citation.

Mr. Burke recommended that they be fined, title searches requested, a lien placed on the property, and then proceed with demolition. Mr. White made the motion to set the fine at $750, a title search requested, and a lien is placed on the property. They would then proceed with demolition.  Chairman Jones second the motion, the motion carried.

The next default case is also Don Peace at 106 East 3rd Street. This is a vacant structure that has been vandalized and mowing needs to be done. It is not slated for demolition. The citation was accepted, but there has been no response. Mr. Burke recommends that a fine be issued, a title search done, and liens placed on the property.

Mr. Knuckles suggested that he felt they also should put in the abatement order that the building be secured and windows boarded up. Mr. White made the motion to, secure the building, do a title search, place a lien on the property, and set the fine at $500. Mr. Knuckles ask if the owner did not secure the property and board the windows up could the city do that. Mr. Burke responded that the city could secure the building. Mr. Knuckles second the motion, the motion carried.

The next default case is Ascensions Group at 307 7th Street. Mr. Burke recommended that they do a title search, place a lien on the property, and set the fine at $500. Chairman Jones made the motion to do a title search, place a lien on the property, fine set at the amount of $500,  in addition to the maintenance fees, and the property owner to make all necessary repairs. Mr. White 2nd the motion, the motion carried.

There was additional discussion in regard to the Ascensions Group. Mr. White suggests that Mr. Burke check to see if the owner of the Ascensions Group has a privilege license.

Chairman Jones brought up the case of James Johnson at 500 North Kentucky Street. Mr. Burke explained that Mr. Johnson has paid his fine, but has not attempted to pay the maintenance fees. Mr. Burke explained that the property had been mowed twice and then he came in and paid the fine. Mrs. Patterson has mailed Mr. Johnson a bill for the maintenance fee with no response. The board will give Mr. Johnson a extension to see if he pays the fees.

The last property on the agenda is Jeff Hotaling at 907 Carter Street.  Mr. Hotaling had a public hearing last year but did not attend due to a birthday party. Mr. Burke did cite Mr. Hotaling a second time. He received his citation and signed for it. Mr. Burke explained that this was to be slated for demolition.

Mr. White ask if we could go and ahead authorize Mr. Burke to proceed with placing a second lien on the property, do a title search and set the fine at $750. Then if he does not comply when the board meets next month they will order demolition. Chairman Jones made the motion to proceed and Mr. White second the motion, the motion carried.

There was discussion on how the mowing services were handled by the code enforcement office.  Mr. Knuckles ask if we had them on a weekly or bi-weekly mowing schedule. Mr. Knuckles also ask if we need a structure secured will public works can do that or will we have to hire someone to do this. Mr. Knuckles had spoken to KEOCC and they had accepted bids to demolish the old hospital.

The Board followed up on the suggestion about the possible change in the regular meeting time to another day. At this time the board has decided to stay with the first Monday of the month.

There was a discussion about mobile homes within the city limits. Mr. Burke explained that an ordinance was drawn up to regulate old trailers. If the owners live in it and own the trailer they can upgrade the mobile home, but if they rent it they cannot upgrade. But the trailers are still in the city limits and are still being rented.

Mr. Knuckles ask about the property on Laurel Avenue and Barbourville Street, a fenced in lot with old cars and very high grass. Mr. Burke noted that it was Hacker Brothers Construction, he  cited them last year and they were maintaining it at the first of the year, but for some reason they stopped. Mr. Burke said he had planned to speak to them again but had not at this time.

The next scheduled meeting will be August 6, 2007.

There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
