TIME AND PLACE
A Public Hearing with the Corbin Code Enforcement Board was held Monday, June 19, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

Status of Case #0606-099 This was a vacant rental property with extensive vandalized damage inside and out of the structure. The abatement date was extended for six months. To date no progress has been noted.
Mr. Burke addressed the board regarding the Default Case of Mr. Earl Karr. Mr. Karr has had one public hearing before the board in regards to his vacant rental property located at 120 Van Dorn. To date Mr. Burke noted no visible repairs have been made. Mr. Karr was ask to re-address the board.
Mr. Karr explained to the board that due to extensive sickness with himself and his wife they have not been able to make the needed repairs to the house. Mr. Karr has asked to have an extension on his time to make the repairs to the house.
Mr. Karr has acquired a carpenter to do the necessary repairs to the home. Mr. Burke stated that Mr. Karr has kept the property mowed and cleaned up. However the damage to the inside and outside of the home must be repaired before it can be rented or lived in.
Mr. Knuckles ask Mr. Burke if he had the original photos and citation of the Karr property. The board looked at the pictures and discussed the damage and repairs needed to be made on the property.
Mr. Karr introduced the carpenter that will be assisting in the repairs the structure. Mr. Burke explained to him what it would take to bring the home up to code standards.
Mr. Knuckles suggested to Mr. Karr and the carpenter that the board could give them 30 days to develop a timetable to present before the board as to how long it would take to do the repairs. Chairman Jones added that if they did the outside repairs first that would give them more time to do inside repairs.
Mr. Burke agreed to go by occasionally to check on the progress. Mr. Karr is to get with Mr. Burke and give him the timetable to submit to the board the July 2nd meeting. Chairman Jones added he would like to see some repairs done on the outside within the next 90 days, and expressed to Mr. Karr his appreciation for addressing the board.
No action will be taken at this time, pending Mr. Burke's receipt of the timetable.
Old Business:
Mr. White mentioned the fact that Hunan and the house behind it has been demolished. Mr. Burke elaborated that he had cited Hunan several years ago; he had been trying to get it demolished. Corbin Towing bought and demolished Hunan and the house. Mr. White ask about the house directly behind Corbin Towing, Mr. Burke stated that they were trying to negotiate with the gentleman living in it. They have proposed a life estate so he could live there through the remainder of his lifetime, at which time the house will revert to Corbin Towing.
Mr. White brought up a house on Van Dorn Avenue, that the grass is overgrown and a lot of shoes on the porch. Mr. Burke stated he had the grass mowed and the shoes cleaned up. Mr. Burke went on to explain it belongs to Mike Sears who has been in jail but has since been released and is living in Berea. Mr. Sears's attorney, Darrell Sanders had informed Mr. Burke that he is trying to force a sale on the house this summer. Mr. Burke has agreed to maintained the property and the attorney has agreed to reimburse the city when the property sales.
Chairman Jones addressed the old gas station property next to Shell and Arby's. Mr. Burke stated he would get the grass mowed this week. Mr. Burke is not sure but from what he is aware of there is still ongoing problems and litigation with the underground gas tanks.
Mr. White brought up the Joy gas station property where the underground gas tanks were removed. Mr. Burke stated that hole has been filled in.
Mr. Burke brought up the Zella Johnson property. Mr. Burke stated he was informed that one brother is trying to obtain rights to all the property from his mother and other two brothers. Attorney Bob Hammons has to release some legal papers from the lawsuit by the city. The brother has promised to maintain the property and hopefully removed the 30+ dogs in the back yard.
Mr. Burke followed up on the Honeycutt property; the city has removed the dumpsters. Mr. Honeycutt has not made any attempt to pay for the dumpster at this time. Mr. Burke has had the grass cut and cleaned up. Mr. Burke spoke to Attorney Bob Hammons and Attorney Hammons ask the board to hold off on the property until the mortgage company forecloses on it. Once the mortgage company forecloses then we can proceed with another notification, and then demolition.
Mr. White and Chairman Jones brought up their doubts of demolishing the property because of the ramifications it could have. Mr. Burke stated he was not sure how much work has been done on the inside, but two 40 yard dumpsters were filled up, Mr. Burke has not done anything else at this time but will contact Attorney Bob Hammons.
Chairman Jones ask Mr. Burke about the rubbish around the Alsip property, Mr. Burke explained he had not followed up on it since last year, but would follow up to see what progress has been made if any.
Mr. White ask what is on the docket for demolition at this time. Mr. Burke explained that the Tom and Lola Higgins home is to be demolished. It should be done in the next 30 days. Mr. Burke explained a citation was sent and returned unopened, Mr. Higgins is deceased.
Mr. Burke stated that he spoke to Attorney Bob Hammons about the Bonza property. The judge gave an extension to the lady that purchased the property to come up with the money. Mr. Hammons is going to follow up with the Judge to ask that no more extensions be permitted and request that the property be rescheduled for resale. The City continues to maintain the property.
Mr. Burke stated that the Wilson property on John Street was demolished by the city. According to Attorney Bob Hammons, the judge has ordered a sale of the property in July. Hopefully it will be sold so we can get some of our funds back.
Mr. Burke discussed that Tri State signs wanted to put signs back up. The signs were torn down when the Cumberland Falls Highway was widened. The state made them take them down and they want to get a permit to put them back up. The city's stand at this time is not to reissue the permit to put them back up under any circumstances.
Chairman Jones ask Mr. Burke what is the status of the old hospital is at this time. Mr. Burke explained that a KCEOC representative was in the office last week. They are doing an environmental impact survey on the site. The KCEOC representative informed Mr. Burke that the building should be demolished within the next 30 days. The KCEOC representative explained to Mr. Burke he had wished to salvage some of the site, but the judge stated it was not to be salvaged but totally demolished.
Mr. White ask about a trailer that was removed on 5th Street. He informed Mr. Burke that there is some plumbing fixtures and pipes still protruding from the ground. Mr. Burke informed Mr. White that they keep the property mowed and kept up, but they cannot put a trailer back on the property as that is not permitted in the city limits.
Mr. Knuckles ask about the Verbal Warnings, Notice of Violations, and Citations that have been noted on the Memorandum sheet. Most of the warnings, violations, and citations are due to grass. Mr. Burke explained how he knocks on the door issuing a verbal warning, or a Notice of Violation is attached to the door if the resident is not at home. After seven days he will issue a citation if no action is taken and have the property mowed and cleaned up.
Mr. Burke stated at this time all the citations are pending. One citation was returned unable to forward, two had no forwarding address and will go into default. Two Don Peace properties have been recited, and two have been received for and he hopes to hear from them this week.
Mr. Knuckles as Mr. Burke where we were with Southside Tire, Mr. Burke stated he had spoken to Attorney Hammons and he said that at this time we should not put liens on personal property. Mr. Burke explained that he had tried to contact Steve Schwartz about the tries, but has been unsuccessful. Mr. Burke will follow up and try to contact the EPA in regard to the tires.
Mr. Knuckles ask about the owners of the 302 South Poplar street property. Mr. Burke has spoken to the new owners of the property, there is some problem with the property line and the owners are going to have it surveyed. Apparently the garage sits on the property line and is attached to the adjoining property carport. The new owners have asked us to send him a bill and he will reimburse the city for any maintenance. He is going to tear the house down and build a new structure as soon as the legalities are straightened out.
Mr. Knuckles ask to have an open discussion on the possibility of changing the Code Board Meeting date. There have been problems in the past and have had to reschedule them. The discussions lead to possibly move the meetings to the Monday on the last full week of the month.
Chairman Jones ask Mr. Burke to look into a property on 8th Street belonging to Lenny Henderlight that may a problem with sewage or some other problem.
Mrs. Patterson ask each of the board members if they would prefer to receive their memorandums and minutes by email or in regular mail, each said it was fine to email their packages to them.
Mr. Knuckles suggested that Mrs. Patterson could forward the citations to each board member when he writes them. Mrs. Patterson stated if the members wished the citations to be forwarded on to them she could do as they requested.
The next scheduled meeting will be July 2, 2007.
There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
