Regular Scheduled Meeting
August 6, 2007
TIME AND PLACE
A Public Hearing with the Corbin Code Enforcement Board was held Monday, August 6, 2007, at 6:00 P.M. at the Corbin City Hall Government Complex Second Floor Courtroom, Room 202.

A status report was given by Mr. Burke. This is a vacant property on Gordon Hill. Mr. Burke stated that he had red tagged the property two separate occasions, each time the red tag disappeared and nothing was done. Mr. Burke sent a citation to the owner of record. Mr. Hensley received the citation on July 27th and has not responded. Mr. Burke has ask the board to make judgment and direct him on how to proceed.
Mr. Knuckles ask what condition the property was in. Mr. Burke explained that the house was in very bad disrepair. A great deal of repairs are needed to bring the house up to code. The grass has not been mowed; this is the same house that at one time had a renter running an illegal business. There has been nothing done to the property since the renter moved out.
With further discussion Mr. Burke stated that the property could be cleaned up but it does not make the building look any better and that was his reason to request demolition. Mr. Knuckles ask if the structure was ready to fall in, Mr. Burke stated it was not ready to fall in but that the building needed secured and if nothing was done that it should be considered for demolition.
Chairman Jones made a motion to increase the fine, do a title search, and place a lien on the property, after further information is received the committee may recommend demolition.

Robert & Melissa Baker 504 3rd Street $100
PVA#137-20-21-026 Vacant Structure/Rubbish
Citation#0607-125 Exterior Structure
A status report was given by Mr. Burke. He stated the property was vacated, property was red tagged, and nothing was done so the city had the property mowed. Since that time the house was placed with a realtor and it has been mowed since. The citation was sent to the address of record and the citation was unclaimed, that does not mean it was wrong, just that the citation was unclaimed.
Mr. Burke called the realtor and the realtor did inform Mr. Burke he would call Mr. Baker and notify them that they have an outstanding balance with the City of Corbin on the property. The property owners still have not responded.
Mr. Knuckles ask how many violations and citations have been placed on the property. Mr. Burke explained that this was the first citation. If the problem is alleviated and then comes up again, it would be considered a second offense.
Motion was made to do a title search, raise the fine, and place a lien on the property.

The Board noted that the September meeting date, the first Monday of September, falls on Labor Day and City Hall is closed in celebration of that Holiday. Mr. Knuckles suggested that the Board meet that Thursday instead of meeting on Labor Day.

A status report was given by Mr. Burke. He stated that we have been maintaining the property for some time and the only address of record is the actual structure. Mr. Burke had it mowed last year and has been mowing it this year. It was red tagged with no response. Apparently Mr. Thompson is deceased and we have been unable to find any relatives to take responsibility for the property.
Mr. Burke stated that in his opinion the only thing left to do is to do a title search and place a lien on the property so we will not lose the maintenance and upkeep fees. He explained the structure is pretty sound, but the grass and weeds continue to grow.
Motion was made to raise the fine to $500, do a title search, and place a lien on the property.

Cecil McFarland 67 Bacon Creek Road $100
PVA# 120-00-00-066 Property Maintenance/Unfit Structure
Citation # 0707-137
A status report was given by Mr. Burke. This is a vacant structure that is in disrepair. The owner's husband has passed away. Her son was working on the house and fell and was injured. Mrs. McFarland contacted the Office of Code Enforcement and explained her predicament and ask if she could have more time in tearing the structure down.
Mr. Burke felt her story warranted more time and has granted her an extension on tearing the structure down.
East Kentucky Power Bacon Creek Road $100
PVA# 120-00-00-065 Unfit Structure/Fire Damage
Citation# 0707-136
A status report was given by Mr. Burke. This structure was burned, it is unsafe and unfit. Mr. Burke has made countless attempts to locate the owner and at this time East Kentucky Power is the only owner of record.
East Kentucky Power has contacted the Office of Code Enforcement and stated they do not own the burned structure only the adjoining lot. Mr. Burke suggested a title search be done and the structure sited for demolition. Motion was made to do a title search, raise the fine to $500, place a lien on the property and scheduled the property for demolition.
If the property does not belong to East Kentucky Power, cite the current owner.

Billy & Deborah Taft 1919 Early Street $100 (Hold)
PVA# 138-30-22-011 Property Maintenance/Unfit Structure
Citation #0707-133 Exterior Structure
A status report was given by Mr. Burke. This house was cited and is in need of demolition. Mrs. Taft contacted the Office of Code Enforcement and has someone scheduled to demolish the structure but he had not been able to get started. Mrs. Taft ask for an extension in order to have the structure torn down. Mr. Burke granted then an extension.
Daniel Seibert 1915 S Kentucky Street $100 (Hold)
PVA# 138-30-25-008 Property Maintenance/ Unfit Structure
Citation #0707-134
A status report was given by Mr. Burke. Between the time Mr. Burke looked at the property and cited the owners they started repairs on the home. If repairs continue Mr. Burke will come before the board and ask that the citation and the fine be rescinded. Mr. Burke felt that the situation warranted an extension for the repairs. He will continue to monitor.
Steven & Kristie Mullins 314 9th Street $100
PVA# 137-40-06-007 Property Maintenance/Unfit Structure
Citation # 0707-139
A status report was given by Mr. Burke. This is a vacant structure that seems abandoned.
Mr. Burke tried to locate the property owners, but has been unsuccessful. The city is presently maintaining the property.
A motion was made to raise the fine to $500, do a title search, and place a lien on the property for all fines, fees, and costs. The property was red tagged but Mr. Burke was not certain if it was removed by the owners.

Old Business:
The property located at Poplar Street and Third. Mr. Burke stated that the problem with it was the dispute over the garage. Mr. Burke spoke to the owner and at this time he plans on tearing the structure down and build a small home there.
Mr. White ask about the status on the Karr property located on Vandorn Street. Mr. Burke stated he had not seen much work done on the property but he would get out there and see exactly what has been done to date.
Mr. White ask about the Mike Sears property. Mr. Burke stated that at this time the City has continued to maintain the property. He explained that Mr. Sears has control of the estate, and his attorney, Darrel Saunders, assured Mr. Burke they are going to try a court sale and would reimburse the City of Corbin for all maintenance and fees owed.
Mr. Jones ask Mr. Burke about the status of the property on 5th Street owned by Henry Honeycutt. Mr. Burke stated that the last he has heard is that the Attorney Bob Hammons has ask to hold off on any action at this time.
Mr. Burke has had the dumpster removed, he has had the property regularly maintained by the city and the fees and fine are mounting. A bill has been sent to Mr. Honeycutt and to date there has been no response.
Mr. Knuckles mentioned that Mr. Honeycutt rents a property on 16th Street that is slowly beginning to look like his other properties.
Mr. Jones ask if we were sure that Mr. Honeycutt had received the bill. Mr. Burke stated that the
regular bills were not sent out certified. Mrs. Patterson stated if the board would like a certified statement sent she would be happy to do so.
Mr. Knuckles ask about the house on 5th Street next to Mr. Honeycutt. The house is in bad
disrepair and needs extensive work done to it. Mr. Burke stated that he was aware of the problem with the home, but in his point of view he did not feel right about citing her when at this time they had not been able to do anything with the Honeycutt property.
Mr. White stated that in fact we can cite the house next to Mr. Honeycutt because demolition has been ordered on the Honeycutt property at this time.
Mr. Burke explained at this time he had no plans in citing the house next to the Honeycutt property, but if it was the wish of the Committee he would do so. His plans were to wait to the conclusion of the Honeycutt issue.
Mr. White ask what was the status of the cleanup of 3rd, 4th, and 5th street that Corbin Housing Authority was working on. Mr. Burke stated at this time the City of Corbin did not get the grant to make the improvements. Mr. Burke explained that the City has reapplied for the grant.
Chairman Jones ask about the status of the Old Hospital. Mr. Burke explained that at this time KCEOC had ask the courts to allow them to utilize the new part of the hospital. Mr. Burke stated the judge had them on a tight schedule but he had not heard anything.
Mr. Burke explained we do have four title searches back and he plans on proceeding with demolition on two. One is the Jeff Hotaling on Carter Street, and the house belonging to Don Peace on 3rd street.
The next scheduled meeting has been tentatively set for September 13, 2007, due to scheduling.
There being no further business or discussion, the meeting was, on motion duly made, seconded, and unanimously carried, ADJOURNED.
